Definitions

• 'We', 'us' and 'our' refer to Rugged and its related entities and businesses.
• The 'Plaform' refers to all mobile and web-based applications we provide.

Agreement

When using our Platform you acknowledge and agree to the following terms of use:

General

• In using the Platform you are deemed to have read and personally agreed to the terms and conditions and privacy policy.
• We own and be entitled to retain and use all data added to the Platform.
• We own all intellectual property rights in the Platform and any materials added Platform. You assign to us any interest you may have or acquire in that intellectual property.
• You agree not to use any content from the Platform for any unlawful purpose.
• You represent and warrant that you are at least 18 years old. This Platform is not designed or recommended for anyone under 18 years old.
• We have the right to refuse to deal with you or cease the provision of any services to you, at any time, at our sole discretion.
• We are entitled at any time, to change, modify, vary, delete or otherwise deal with the Platform and/or the terms and conditions, as we see fit.
• These terms supersede any prior agreements or understandings made with us.

Subscriptions

• Your subscription will automatically renew for the same term of your initial subscription unless you cancel your subscription via the billing platform your subscription was purchased on.
• We do not offer refunds for any reason, unless required by law to do so.
• At the end of your paid subscription period. We can deactivate your account and cease the provision of any services to you.
• We can terminate your subscription at any time at our sole discretion.

Limitation of Liability

• You acknowledge that your participation in any physical activity included in our Platform involve risks, including personal injury and death. By participating, you are doing so voluntarily and at your own risk. You assume all risks and responsibility for any potential harm or injury that may occur while using our Platform.
• You agree to release and hold harmless Rugged, its employees, affiliates, and suppliers from any claims, demands, or liabilities arising from the use or misuse of the Platform.
• You should first consult an appropriately qualified healthcare professional before performing any physical activity included in our Platform.
